A- Ancient History:
1) Hammurabi Code: The Hammurabi Code or Babylonian Code was set up by 1772 B.C. It consist of 282 laws related to all aspect of social life accompanied with sanctions. It sets categories of social status and categories members such as slaves and free men. This code put in place the rules related to contracts, transactions, responsibility and liabilities, household and family relationship such as inheritance, marriage, divorce and sexual behavior. Part of the code provides duties and obligations on officials and judges and charges them sanctions in case of lack of duty. In fact it was the first known Code that establishes the principle of “Rights” in different matters although there were not exactly Human Rights as we define nowadays. And one cannot deny the Chart of Hammurabi that set some important rights and rules. Rome was the first empire to establish a written legislation (jus civile).
2) A Pharaoh of Ancient Egypt (c 2000 BC) was quoted as giving instructions to subordinates that ‘When a petitioner arrives from Upper or Lower Egypt, … make sure that all is done according to the law, that custom is observed and the right of each man respected.’
3) The Charter of Cyrus (Iran, c 570 BC) was drawn up by the king of Persia for the people of his kingdom, and recognized rights to liberty, security, freedom of movement and some social and economic rights.
4) Buddhism: Simultaneously at the sixth century BC one monk from Sakya tribal in the city of Kapilavastu in India founded the Buddhist concept that prevailed in India and China and Japan and Vietnam and other Asian areas. The term Buddha means in indie the brave and wise. Buddha or Buddha means Hinduism prophetess and an open and brand. Duhkha and this belief is based on the principle key which is evil (duhkha) whether physically or psychologically. For Buddhism One should pass through different stage to attain the purity and final stage: the salvation (Nirvana) and promote the virtues and attain the eight examples (Nirvana). This stage is physical and moral. One must determine the evil and harm him occupied. The second fact relates to the identification of the source of this evil. . And that ignorance is the Buddha of human appetite and lead he to emerge from the three vices and evil are: greed and hatred and mistake (vipaka). And when he obtain the control of the eight virtues and opinion is right, good faith, the word good, proper physical activity, effort, naturally, the attention of the center, appropriate means of living, and focus my mind right (Marga). There are two ways to gain access to through these ideals (Marga) and (Yoga) i.e. meditation (dhyana). And this is what he calls the Buddha teachings. It is clear that the teaching of Buddhism is based on behavioral humanity to attain the ethical rules.
5) Confucius philosophy and human rights: The Confucian saw the light at the hands of the Chinese thinker Kong fu Zi or K’ong-fou-Tsen that the Jesuits monks translate it in Latin Confucius. This philosophy is based on the existence of a perfect human being (junzi) who has all the virtues and values (rem). Any person who desires to possess in order to salvation should believe in high ethical rules of Confucius and the balance of the community. Ethic is the base of the philosophy. Confucius attacked those who claim knowledge of astrology and the unseen metaphors of life and their ignorance of a lot of things: “You who know nothing of this life, what do you know about the unseen and death?”. He urged men to work and not only to think and analysis. The problems of humanity lies in everyone and solutions emerge from the will of men and his thought and action.
In Buddhism as well as in Confucian rules No specific human rights are prescribed. However the teachings and the moral behavior and ethics directives and the will of the ideal man to lead to good society preserve the rights of its members.
6) One cannot explain the historical background of human rights without stepping by the tremendous influence of Greek and Roman civilizations on the Right Theory and on human rights indirectly. Greek philosophers and thinkers headed by Aristotle, Plato, Cicerone and others illustrate human philosophical and logical values. These Ideas and ethics shall have important effects on values, logic and laws in Europe. The humanity owes a lot to Greek philosophers who set up the human principles of dignity and ethic. The contribution of Plato and Cicerone and Aristotle and others to human rights is not direct in that sense that they establish the human rights as we define actually. They put in place humanitarian general principles that preserve human dignity and freedom. We can state that Greek philosophy is the intellectual root of the human right principles. The ideals of cicerone, the Republic of Plato, and the logical wisdom of Aristotle are some examples.
7) Not far from there, the Roman Empire founded the first written civil laws that protect Rome citizen and organize their relationship (jus civile) and the relation between Rome and the submitted provinces (jus gentium). These codes were the first written coded laws that were followed and adopted by all following civilizations. That is why we call the written civil code system Romano-Germanic.
B- Human Rights and Religions and Dogmas:
1) Human rights in Christian religion: Since the occurrence of monotheistic religions the theology occupied a wide place among thinkers, theologians for the development of legal rules derived from religious values and principles. For an amount of Christian searchers, Saint Augustine is the father of Christian thought and the author of canon law. He refers to the absolute will of the Divinity for the resolution of people affairs and for solving their problems. He considers that the only law that may be applied is the will of God as expressed in his holly books and teachings. For Saint Augustine no rights are to be found outside the boundaries of holly books and teachings of the Lord (The Torah and the Bible). The philosophy of John of Damascus was based on a combination of faith, relying at the same time on logic and rational insight in the analysis and discussion. Then, legal thought evolutes by some Christian thinkers who have been inspired by the logic of Aristotle transmitted to them by the Arab/Muslim philosopher Averroes (Ibn Rushd), and created a school of legal status. The Arab-Islamic studies and thought affected and inspired all orient thinkers including Christian thinkers as well as Western, Their studies, scholars and philosophers, and science were transmitted to the West through translation into Latin, which was credited to the senior Arab Christian and Muslim translators such as Hunayn ibn Ishaq and his son Ishac and Joan Bin Messoueh and Thabet bin Korra and Kosta bin Louka who contributed to translate foreign theologies and philosophies to Arabic and vice versa. A significant number of important thinkers and philosophers and theologians (such Saint Thomas, Albert Le Grand, Guillaume D’Occam, Dan Scott And Eckhart and others) followed Aristo Logic and adopted rules similar to the status of Roman laws emanating from the divine ethical principles. They called for the adoption of reason and logic and to rely on human responsibility and intelligence in bringing solutions and edifying rights. St. Thomas Aquinas is considered the father of the written positive law school. He was influenced by Averroes theories and explanation of Aristo’s logic. This movement was followed by the Franciscan Guillom D’Occam, who founded the Franciscan thought at the University of Oxford to lay the new foundations for the logical scientific thought that accommodated the rights of the human personality within the framework of positive law. This period was followed by an uprising by the theological protestation lead by Luther in Germany and Calvin in Geneva. In due course some other legalists emerged and issued important legal principles such as Grotius and Pufendorf in Holland. The period between the twelfth and the sixteenth century was characterized by considerable intellectual and sometimes bloody conflicts on the subject whether the religious or the civil authority should prevail.
2) Human Rights in Arab world and Islam: the first idea of man’s right was born in the city of Makah by the end of the sixth century further to a dispute between a Yemenite passing trader and a local distributer who tried to deny the trader’s rights. The Yemenite then claimed his due to the chiefs of tribal prevailing by that time. The Chiefs met and declared a pact according to which no Right can be dismissed or denied in the city. This meeting and the out coming pact were called “Jameh Al Foudoul”[ جمع الفضول]. When the Messenger Mohammad[ صلعس] learned about it later, He blessed and approved.
As far as Human Rights in Islam are concerned, we can notice first that, alike Christian religion, Islam upgrades the image of the human being and considers it at the image of his Creator and Islamic scholars and thinkers adopt in general this principle considering that God has created man in the best picture. The man was honored in the Qur’an in more than Surat. “And have created the human in the best of molds” (surat 4). “Then He fashioned him and breathed into him of His Spirit” (Sura – 9). And preferred him to all other human beings: “And we have honored the sons of Adam and carried them on land and sea and provided them with good things and preferred them above many of those who created favorable” (Isra -70, Al Teen 4, Al Sujudah 9)[ “و قد خلقنا الانسان في أحسن تقويم” (التين-4). “ثم سواه و نفخ فيه من روحه” (السجدة – 9). و فضل الانسان عن سائر المخلوقات: “و لقد كرمنا بني آدم و حملناهم في البر و البحر و رزقناهم من الطيبات و فضلناهم على كثير ممن خلقنا تفضيلا” (الاسراء-70).].
The Islamic faith establishes in the Qur’an and the Hadith some basic principles relating to certain rights aiming to protect the human Being and instituting related Rights. From the perspective of the Quran these Rights came into existence and were created by God. Not only these Rights provide us with some opportunities to develop all our inner resources, but also they hold before us a vision of what God would like us to be and strive for and live for and behave in our relation to each others. These Rights cannot be abolished. They are eternal and immutable. What are these rights?
- Right to life by refusing killing in general and in particular by abolishing girl bearing (Al Nahel 57-58, Al Omran 21, Al Isra’a 33, Al Anaam 151)[ ” وإذا بشر أحدهم بالأنثى ظل وجهه مسودا و هو كظيم، يتوارى من القوم من سوء ما بشر به : أيمسكه على هون أم يدسه في التراب ألا ساء ما يحكمون” (النحل 57- 58)، “إن الذين يكفرون بآيات الله و يقتلون النبيين بغير حق و يقتلون الذين يأمرون بالقسط من الناس فبشرهم بعذاب أليم” (عمران 21)، لا تقربوا مال اليتيم إلا بالتي هي أحسن حتى يبلغ أشده و أوفوا الكيل و الميزان بالقسط لا نكلف نفسا إلا وسعها و إذا قلتم فاعدلوا”، و لا تقتلوا أولادكم من أملاق نحن نرزقكم و إياهم و لا تقربوا الفواحش ما ظهر منها و ما بطن و لا تقتلوا النفس التي حرم الله إلا بالحق” (الأنعام 151، 152) “و لا تقتلوا النفس التي حرم الله” (الإسراء 33)، “و لا تكسب كل نفس إلا عليها و لا تزر وازرة وزر أخرى” (الأنعام 164) ] , and enjoying life (Al Bakara 172, Al Maida 87, 96, Al A’araf 31, 32, Al Nahel 5,6, Al Nahel 65, 66,67, Taha 53,54, Yassine 33,34,35, 71,73, Al Mou’minoun 19, 20, 21)[ يا أيها الذين آمنوا كلوا من طيبات ما رزقناكم و اشكروا الله (البقرة 172)، “يا أيها الذين آمنوا لا تحرموا طيبات ما أحل الله لكم و لا تعتدوا إن الله لا يحب المعتدين (المائدة 87) ، “أحل لكم صيد البحر و طعامه متاعا لكم” (المائدة 96) ، “خذوا زينتكم عند كل مسجد و كلوا و اشربوا و لا تسرفوا إنه لا يحب المسرفين” (الأعراف 31)، “قل من حرم زينة الله التي أخرج لعباده و الطيبات من الرزق قل هي للذين آمنوا في الحياة الدنيا” (الأعراف 32)، “و الأنعام خلقها لكم فيها دفء و منافع و منها تأكلون، و لكم فيها جمال حين تريحون و تسرحون” (النحل 5،6)، “و الله أنزل من السماء ماء فأحيا به الأرض بعد موتها إن في ذلك لآية لقوم يسمعون، و إن لكم في الأنعام لعبرة نسقيكم مما في بطونه من بين فرث و دم لبنا خالصا سائغا للشاربين، و من ثمرات النخيل و الأعنب تتخذون منه سكرا و رزقا حسنا” (النحل 65،66،67)، “جعل لكم الأرض مهدا و سلك لكم فيها سبيلا و أنزل من السماء ماء فأخرجنا به أزواجا من نبات شتى، كلوا و ارعوا أنعامكم إن في ذلك لآيات لأولى النهى” (طه 53،54) ، “وأية لهم الأرض الميتة أحييناها و أخرجنا منها حبا فمنه يأكلون”، “و جعلنا فيها جنات من نخيل و أعناب و فجرنا فيها من العيون”، “ليأكلوا من ثمره و ما عملته أيديهم أفلا يشكرون”، ” أولم يروا أنا خلقنا لهم مما عملت أيدينا أنعاما فهم لها مالكون”، “و لهم فيها منافع و مشارب أفلا يشكرون” (يس 33، 34، 35،71، 73) ، “فأنشأنا لكم به جنات من نخيلو أعناب لكم فيها فواكه كثيرة و منها تأكلون”، “و شجرة تخرج من طور سناء تنبت بالدهن و صبغ للآكلين”،”و إن لكم في الأنعام لعبرة نسقيكم مما في بطونها و لكم فيها منافع كثيرة و منها تأكلون” (المؤمنون 19، 20، 21) ]
- Right to justice: The Koran and Hadith insist on justice and fair treatment between muslims and others (Al Hajar 85, Al Jathia 22, Al Ma’ida 8, Al Bakara 282, 286, Al Nisa’a 58, Al An’am 152, 164, Al A’araf 85, Al Nahel 91, Isra’a 35, Al Nisa’a 29, Chouara’a 181, 182, 183, Al Nahel 90)[ “و ما خلقنا السموات و الأرض و ما بينهما إلا بالحق” (الحجر 85) و ” وخلق الله السموات و الأرض بالحق و لتجزى كل نفس بما كسبت و هم لا يظلمون” (الجاثية 22) ، “يا أيها الذين آمنوا كونوا قوامين لله شهداء بالقسط، و لا يجرمنكم شنئان قوم على ألا تعدلوا، اعدلوا هو أقرب إلى التقوى، و اتقوا الله إن الله خبير بما تعملون” (المائدة 8) ، “إذا تداينتم بديت إلى اجل مسمى فاكتبوه و ليكتب بينكم كاتب بالعدل و ليملل الذي عليه بالحق” (البقرة 282)، “لا يكلف الله نفسا إلا وسعها لها ما كسبت و عليها ما اكتسبت” (البقرة 286)، “إن الله يأمركم أن تؤدوا الأمانات إلى أهلها و إذا حكمتم بين الناس أن تحكموا بالعدل” (النساء 58) ، “فأوفوا الكيل و الميزان و لا تبخسوا الناس أشياءهم و لا تفسدوا في الأرض بعد إصلاحها” (الأعراف 85)، و أوفوا بعهد الله إذا عاهدتم و لا تنقضوا الإيمان بعد توكيدها” (النحل 91)، و أوفوا الكيل إذا كلتم و زنوا بالقسطاس المستقيم” (الإسراء 35)، “لا تأكلوا أموالكم بينكم بالباطل إلا أن تكون تجارة عن تراض منكم” (النساء 29) ، “للرجال نصيب مما اكتسبوا و للنساء نصيب مما اكتسبن” (النساء 32) ،”يا أيها الذين آمنوا كونوا قوامين بالقسط شهداء الله و لو على أنفسكم و الوالدين و الأقربين إن يكن غنيا أو فقيرا فالله أولى بهما فلا تتبعوا الهوى أن تعدلوا و إن تلوا أو تعرضوا فإن االه بما تعملون خبيرا (النساء 135)، “و أوفوا الكيل و لا تكونوا من المخسرين”، “و زنوا بالقسطاس المستقيم”، “و لا تبخسوا الناس أشياءها و لا تعثوا في الأرض مفسدين” (الشعراء 181، 182، 183)، “إن الله يأمر بالعدل و الإحسان و إيتاء ذي القربى” (التحل 90) ]
- Right to equality between human being and between man and woman by instituting personal independent rights to the woman including independent civil, propriety, heritage and financial personal rights (Al Hujurat 13, Al Nisa’a 6, 7, 8, 9, 10, 11, 12, 32, 135, Al Chou’oura’a 181, 182, 183) [ “يا أيها الناس إنا خلقناكم من ذكر و أنثى، و جعلناكم شعوبا و قبائل لتعارفوا، إن أكرمكم عند الله أتقاكم” (الحجرات 13)]
- Right of faith and thought, Tolerance and fair discussion (Al Bakara 256-263, Al Kafiroun 6, Al Nahel 125, Al Ankabout 46, Fousilat 34)[“لا إكراه في الدين، قد تبين الرشد من الغي” (البقرة 256) قول معروف و مغفرة خير من صدقة يتبعها أذى (البقرة 263)، و “لكم دينكم و لي ديني” (الكافرون 6)، و إدع إلى سبيل ربك بالحكمة و الموعظة الحسنة و جادلهم بالتي هي أحسن (النحل 125)، “و لا تجادلوا أهل الكتاب إلا بالتي هي أحسن” (العنكبوت 46)، “و لا تستوي الحسنة ولا السيئة ادفع بالتي هي أحسن فاذا الذي بينك و بينه عداوة كأنه و لي حميم ” (فصلت 34) ]
- Right to human dignity (Al Nour 19, 34, 60, Al Isra’a 70, Sourat Abasa)[ “إن الذين يحبون أن تشيع الفاحشة في الذين آمنوا لهم عذاب أليم” (النور 19) ، “و القواعد من النساء الاتي لا يرجون نكاحا فليس عليهن جناح أن يضعن ثيابهن غير متبرجات بزينة و أن يستعففن” (النور 60) “و لقد كرمنا بني آدم و حملناهم في البر و البحر و رزقناهم من الطيبات على كثير ممن خلقنا تفضيلا” (الاسراء 70)، “و لا تكرهوا فتياتكم على البغاء” (النساء 34)]
- Right to personal reputation (Al Nour 13, 23)[ “لولا جاؤا عليه بأربعة شهداء فإذا لم يأتوا بالشهداء فهؤلائك عند الله هم الكاذبون”، “إن الذين يرمون المحصنات الغافلات المؤمنات لعنوا في الدنيا و الآخرة و لهم عذاب عظيم” (النساء 13، 23) ]
- Right to respect and privacy and home immunity (Al Nisa’a 19, 23, 24, AlNour 27-28)[ “يا أيها الذين آمنوا لا تدخلوا بيوتا غير بيوتكم حتى تستأنسوا و تسلموا على أهلها ذلكم خير لكم لعلكم تذكرون فإن لم تجدوا فيها أحدا فلا تدخلوها حتى يؤذن لكم و إن قيل إرجعوا فارجعوا هو أزكى لكم و الله بما تعملون عليم” (النور 27 – 28)]
- Right to elder and Parent dignity and respect (Al Isra’a 23, 24, Loukman 14)[ و قضى ربك ألا تعبدوا إلا إياه و بالوالدين إحسانا إما يبلغن عندك الكبر أحدهما أو كلاهما فلا تقل لهما أف و لا تنهرهما و قل لهما قولا كريما”، و اخفض لهما جناح الذل من الرحمة و قل رب ارحمهما كما ربياني صغيرا” (الإسراء 23، 24)، “و وصينا الإنسان بوالديه حملته أمه وهنا على وهن” (لقمان 14)]
- Right to education (Al Bakara 151, Taha 114, Al Rahman 2, 4, Alak 1, 4, 5) [، “قل رب زدني علما” (طه 114) ، علم القرآن، علمه البيان (الرحمن 2،4)، “إقرأ باسم ربك الذي خلق”، “الذي علم بالقلم”، “علم الإنسان ما لم يعلم” (العلق (1، 4، 5) حق العلم كما جاء في الحديث الشريف “طلب العلم فريضة على كل مسلم”]:
- Right to personal freedom[ ، “ما كان لبشر أن يؤتيه الله الكتاب و الحكم و النبوة ثم يقول للناس كونوا عبادا لي من دون الله و لكن كونوا ربانيين بما كنتم تعلمون الكتاب و بما كنتم تدرسون” (آل عمران 79) قال الخليفة عمر “متى استعبدتم الناس و قد ولدتهم أمهاتهم أحرارا”] and Liberty of will and choice (Al Tawba 105, Houd 108, Isra’a 15, Al Omran 79) [ ” و قل اعملوا فسيرى الله عملكم و رسوله و المؤمنون و ستردون إلى عالم الغيب و الشهادة فينبئكم بما كنتم تعملون” (التوبة 105)، “قد جاءكم الحق من ربكم فمن اهتدى فإنما يهتدي لنفسه و من ضل فإنما يضل عليها و ما أنا عليكم بوكيل” (هود 108)، “من اهتدى فإنما يهتدي لنفسه و من ضل فإنما يضل عليها و لا تزر وازرة وزر أخرى” (الإسراء 15) ]:
- Peace: In general The Koran considers war as last remedy against “others” attempts and attacks and as a self defense for the protection of the new gnosis and faith. However it results from the following Ayats that Koran recommends serenity and peaceful solutions (Al Ma’ida 54, Al Bakara 143, al Nisa’a 92, Al Anfal 60, 61, Younes 25, Al Hujurat 9, Roum 21) [ “و ما كان لمؤمن أن يقتل مؤمنا إلا خطئا ” (النساء 92)، “و كذلك جعلناكم أمة وسطا لتكونوا شهداء على الناس” (البقرة 143) “و أعدوا لهم ما استطعتم من قوة و من رباط الخيل ترهبون به عدو الله و عدوكم” (الأنفال 60) ” و إن جنحوا للسلم فاجنح لها و توكل على الله” (الأنفال 61) ، و الله يدعوا إلى دار السلام و يهدي من يشاء” (يونس 25)، “و إن طائفتان من المؤمنين اقتتلوا فأصلحوا بينهما فإن بغت إحداهما على الأخرى فقاتلوا التي تبغى حتى تفئ إلى أمر الله فإن فاءت فأصلحوا بينهما بالعدل و أقسطوا إن الله يحب المقسطين” (الحجرات 9) “و من آياته أن خلق لكم من أنفسكم أزواجا لتسكنوا إليها و جعل بينكم مودة و رحمة إن في ذلك لآيات لقوم يتفكرون” (الروم 21 ]:
- Alike the conflict between the intelligentsia and the religious authorities in the Christian areas the Islamic Khilafa faced the same quarrel but not at the same intensity and equal differences. In Fact the Sultan or Islamic Caliph or Prince were ruling in the name of religion and that the latter were funding religious scholars and guiding them in most cases. The temporal authority was in the same time the civil legal and religious one. The Caliph was ruling in the name of Islam religious as well as personal civil affairs of citizens.
- In conclusion, before the edition and the implementation of the International Human Rights’ Chart of 1948, one could find in the antique world as well as in the religious recommendations and directives and principles that aim to preserve and protect Human being and their fundamental rights to life, to freedom and to dignity.
